housing providers continue to endure which has only been exacerbated by current ever-increasing inflationary pressures and the loss of naturally occurring affordable housing which will likely result as small independent owners leave the business. During the meeting, the business industry reiterated their opposition to a business license tax rate increase and the impact to the City’s small businesses who continue to experience severe COVID-19 related financial hardships. The City Council had previously discussed this proposal at its May 23rd meeting, at which time due to a tie vote no action was taken. Councilmembers Eriksson and Vera, recognizing the challenges facing the City’s small businesses maintained their opposition to placing the tax increase on the November 2022 Ballot. Higher business license fees such as those being proposed by Culver City are merely passed along to consumers in the form of higher prices.
It is anticipated that City Staff will return at the July 11, 2022, City Council meeting with a draft proposed ordinance and ballot measure language. The deadline for placing a measure on the November 2022 Ballot is August 12, 2022.
Pasadena City Council Directs Staff to Draft Building Decarbonization Ordinance
At its June 13th meeting, the City Council continued discussions on building decarbonization and directed staff to draft an ordinance. The proposed ordinance will amend the City’s Health and Safety Code to require that the following categories of new construction use an all- electric design: new multi-family residential buildings with more than 3 units, new mixed-use buildings, and new non- restaurant commercial buildings. The proposed ordinance will also apply to existing commercial buildings where there is an addition of 50% or more added to the existing floor area. While the City Council discussed expanding the electrification requirements to newly constructed single- family homes and accessory dwelling units, based on City staff recommendations, the Council will postpone inclusion of these structures for one year, pending City staff’s return with an analysis of the effects and benefits of building electrification in reducing the City’s carbon footprint.
San Fernando Adopts Smoke-Free Housing Ordinance
At the June 6th San Fernando City Council meeting, the Council adopted an ordinance prohibiting smoking in multi-unit housing for all new construction and for new leases with a phasing-in period for existing units. The ordinance goes into effect on July 7, 2022 and applies to multi-unit housing within the City with two or more units.
Below is a brief summary of the ordinance requirements, we encourage members with property in the City of San Fernando to review the full details of the ordinance.
• Smoke-Free Ordinance Applicability. The ordinance applies to multi-unit housing which is defined as “a residential property containing two or more units, including but not limited to, apartment buildings, common interest developments, senior and assisted living facilities, and long-term health care facilities.”
• Smoking Prohibition – Phased-In. As of July 7, 2022, smoking is prohibited in multi-unit housing in all newly constructed units and existing units when there is a new lease, and the prohibition extends to the unit’s associated outdoor, unenclosed areas such as private balconies, decks, porches, or patios. After two years, smoking will be prohibited anywhere on the premises of multi-unit housing: in all multi-unit housing units including any associated outdoor areas such as patios, balconies and decks and all common areas with the exclusion of a designated smoking area. The ordinance specifies the parameters of a designated smoking area.
For the first five years until July 7, 2027, smoking is permitted inside of a detached unit. However, smoking is not permitted in any outdoor exclusive- use unenclosed areas connected to the detached unit such as the balcony, deck, or patio.
