initial concerns on the matter with the Los Angeles Housing Department (LAHD) and will maintain an ongoing dialogue relative to the implications of such policies as LAHD continues exploring building decarbonization and reports to the City Council with recommendations for meeting the City’s zero carbon emissions buildings’ goals.
Los Angeles County Eviction Moratorium – Prohibitions on Evictions Based on Non-Payment of Rent Reinstated on July 1, 2022
In January 2022, the Los Angeles County Board of Supervisors adopted a phased plan that extended the Countywide eviction moratorium through the end of 2022 and potentially to some degree through June 30, 2023. The plan is currently in Phase 2, which is from June 1, 2022 through December 31, 2022. Under this phase, eviction prohibitions related to nuisance, unauthorized occupants or pets and no-fault reasons with limited allowances for owner move-in remain in effect. Additionally, effective July 1st, the prohibition on eviction for non-payment of rent due to COVID-19 financial hardship is re-instated for renters in households with an income at or below 80% Area Median Income (AMI) for rent due on or after July 1st. Eligibility is based on renter self-certification.
The rent increase freeze which applies to all rent stabilized units in the County’s unincorporated areas regardless of whether or not the renter is financially impacted by COVID-19 also remains in effect through the end of the year.
The Association has strongly advocated for the County’s moratoriums on evictions and broad ban on rent increases to end immediately. Localities such as Pasadena and Beverly Hills have recently ended their eviction moratoriums and/or rent increase freezes. Not only is the County maintaining their moratoriums, but it is re-instating prohibitions concerning non-payment of rent. Moreover, with the State’s Rent Relief Program application period closed on March 31, 2022, renters who had not submitted an application can no longer seek State rental assistance and related protections. Reintroduction of prohibitions on evictions for non-payment of rent
will merely allow renters who have not met the State’s application deadline or qualifications, to not pay current rent owed. These residents may presume that since the County’s eviction moratorium is in effect so too does the opportunity to seek financial assistance through the State’s Rent Relief Program or even through the County.
While COVID-19 will remain part of our lives for the foreseeable future, we have obtained significant knowledge since its onset in early 2020 and we have gained many essential tools needed to safely treat and navigate the disease through the coming months and years. At this juncture, there is no further rental assistance for periods beyond March 31, 2022 from the State and all other business sectors have resumed normal operations. Accordingly, the rental housing industry must also be allowed to operate as it once did prior to the onset of the pandemic.
Culver City Council Moves Forward With A Business License Tax Increase Ballot Initiative for the November 2022 Election
At its June 13th meeting, the Culver City Council voted 3 to 2, with Councilmembers Vera and Eriksson opposing, to move forward with placing a Business License Tax rate increase on the November 2022 Ballot. The City Council also established an Ad Hoc Business License Tax Ballot Committee and appointed Councilmembers Fisch and Vera to the committee.
The Committee will work with City Staff on addressing the following matters: “(1) development of a new proposed business license tax structure, (2) whether or not to provide exemptions to businesses on the first $100,000 of gross receipts, (3) whether or not to allow for annual Consumer Price Index Increases, (4) writing the arguments in favor of the Measure if the city council votes to place it on the ballot, (5) If desired, a public education program to inform the public about the ballot measure.”
