Cause provisions (“Fully Covered Units”) and $30 per unit for rental units subject to the County’s Just Cause provisions but exempt from the County’s RSO (“Just Cause Units”) in the County’s unincorporated areas. During the pandemic, the Board of Supervisors has been waiving the registration fee for rental housing providers that comply with the annual rent registration requirements. Based on the Board’s most recent action, rental housing providers who rent units in Los Angeles County’s unincorporated areas have until September 30, 2022, to register their units to receive the fee waiver through June 30, 2023.
Bell Gardens City Council Adopts an Interim Urgency Ordinance Banning Residential Rent Increases for 90 Days Through July 24, 2022
At the April 25th Bell Garden’s City Council meeting, the Council unanimously adopted an interim urgency ordinance prohibiting residential rent increases for the next 90 days, through July 24, 2022 unless extended, pending the City’s preparation of a draft rent control ordinance. The ordinance applies to all residential rental units subject to Assembly Bill 1482 that are occupied by an existing renter whose tenancy began before or on April 25, 2022. The ordinance also specifies that “a decrease in Housing Services is considered an increase in rent.” Owners may apply for a rent increase through a petition process and are required to prove that due to the interim ordinance, they are unable to obtain a fair and reasonable return.
During the Council meeting’s extensive public comment, numerous Bell Gardens small business rental housing providers spoke in opposition to the City’s adoption of the interim urgency ordinance, expressing that many owners are contemplating or on the verge of selling their properties and urging the Council to recognize the negative consequences of this ordinance. Beverly Hills Ends City’s Moratorium on Evictions and Rent Increases on May 31, 2022
At the May 10th Beverly Hills City Council meeting, the
Council adopted an ordinance, ending the City’s local eviction moratorium and rent increase freeze effective on May 31, 2022, and allowing for a maximum rent increase of up to 3.10% during the period of June 1, 2022, through June 30, 2023 with respect to current renters living at a property before July 1, 2019. Additionally, effective June 1, 2022, the one-year deferred rent repayment period will commence, and the City’s renters will be required to repay any past due, COVID-19 related rent in full by May 31, 2023. The ordinance goes into effect on June 10, 2022.
We encourage members with property in the City of Beverly Hills to review the full details of the ordinance in combination with the applicability of the existing Los Angeles County Eviction Moratorium and potential applicability of the State’s COVID-19 protections and consult with an attorney regarding specific tenancy questions.
The 3.10% is reflective of the permissible rent increase that would have been allowed during 2019-2020. Property owners who did not issue any rent increase or issued a rent increase that was less than 3.10% during the period from July 1, 2019 through June 30, 2020, may issue a maximum rent increase of up to 3.10% during the period from June 1, 2022 through June 30, 2023. Property owners that may have issued a rent increase that was less than 3.10% from July 1, 2019, through June 30, 2020 may issue a rent increase equal to 3.10% less the amount of the previous increase. By way of example, for a rent increase of 1% given from July 1, 2019, through June 30, 2020, a property owner is now permitted to issue an additional rent increase of up to 2.10%.
It is important to note that the City’s position is that no increase may be issued if the current renter’s tenancy started on or after July 1, 2019 as they would not have been subject to a rent increase during the period of July 1, 2019 through June 30, 2020.
