• Assembly Bill 2021. (Wicks) Property Tax, Sales - This bill would require tax collectors, by July 30th of each year, to prepare a listing of all properties that have been on the tax delinquent role for at least 5 years, or at least 3 years after the property has become tax defaulted and is subject to a nuisance abatement lien, and would require the tax collector to notify the city, county, and qualifying nonprofit organizations that the properties on the list are available for purchase for an “approved public purpose,” which includes housing for low- or moderate-income persons, supportive housing, supportive services, open space, or any other use that serves low- or moderate-income persons. Existing law generally authorizes a county tax collector to sell tax-defaulted property 5 or more years after the real property has become tax defaulted. OPPOSED
• Assembly Bill 2050. (Lee) Restrictions on use of Ellis Act – This bill would require notifying a public entity of intent to withdraw a property from rental market, and to identify each person or entity with an ownership interest in the property. The bill would prohibit an owner (other than a natural person or LLC formed by 4 or fewer natural persons or trusts with natural person beneficiaries) from withdrawing accommodations from rental market for a period of 5-years from purchase or for 10-years from when a previous property was withdrawn. Exemptions given for smaller owners (4 or fewer units). OPPOSED
• Assembly Bill 2053. (Lee) Creates the Social Housing Act and would establish the quasi-governmental authority, California Housing Authority, to produce and acquire social housing developments for the purpose of eliminating the gap between housing production and regional housing needs. OPPOSED
• Assembly Bill 2203. (Rivas) Credit Report in Rental Housing Application - Would prohibit requiring a consumer credit report - as part of the application process for a rental housing accommodation in instances where there is a government rent subsidy. OPPOSED
• Assembly Bill 2290. (Carrillo) Unlawful Detainer - This bill would prohibit a court clerk from allowing access to the records of certain unlawful detainer actions (withdrawal of accommodations) and would require the owner in that case to identify the type of unlawful detainer action in the caption of the owner’s complaint. OPPOSED
• Assembly Bill 2297. (Wicks) Fee in lieu of a security deposit - Would require a landlord who offers a tenant or prospective tenant the option of paying a fee in lieu of a security deposit to take certain action, including offering the tenant or prospective tenant the option to instead pay a security deposit.
• Assembly Bill 2383. (Jones Sawyer) “Ban the Box in Rental Applications” - Would make it an unlawful housing practice for the owner of a rental housing accommodation or business establishment to inquire about or require an applicant for a rental housing accommodation to disclose, a criminal record during the initial application assessment phase. (Note: Owner has 5 days to notify of denial an applicant given 3 days to appeal.) OPPOSED
• Assembly Bill 2469. (Wicks) “Rent Registry” - Would create a rent registry to collect information from landlords including, the address and owners of a rental property, the number and type of rooms in the rental property, and information related to the payments collected and the duration of tenancies. OPPOSED
• Assembly Bill 2710. (Kalra) T.O.P.A. Bill - This bill would require an owner of a property occupied by a tenant to notify each tenant and qualified entity the intent to sell the property and would provide the qualified entity with 10 days to notify the property owner of their interest in purchasing the property and further provide an entity with either 60 days or 40 days, depending on the number of units of the property, to submit an offer to purchase the property. This bill would allow a property owner to sell the property to any party if the property owner does not receive interest to purchase
