The initial motion on this matter was discussed in the City’s Energy, Climate Change, Environmental Justice and River Committee meeting. Nearly two years into the COVID- 19 pandemic during which City mandates have banned annual rent increases and severely affected rental housing providers ability to collect rent, deferment of the 7.8% annual RecycLA rate increase is simply insufficient. During the meeting’s public comment, the Association expressed opposition to the January increase and urged the Committee to waiver or at minimum suspend the rate increase until the City’s eviction moratorium and rent increase freeze are lifted. We reiterated our opposition and recommendations in a letter to the full City Council.
Los Angeles City Council Once Again Extends Local Emergency and Related Emergency Measures
On Tuesday, February 1st, the Los Angeles City Council once again extended the City’s local emergency for another 30 days, with Councilmember’s Buscaino and Lee voting in opposition, and with that extension the continued extension of the City’s eviction moratorium and rent increase freeze ordinances, whose expirations are directly linked to the end of the local emergency.
During the meeting, Councilmember Buscaino noted the significant changes that have occurred since the local emergency was adopted nearly two years ago, highlighting local vaccination rates, examples of the economic rebound, and expert opinion on the current variant. He also spoke to the imbalance created by the continual extension of the order and the harm to the smaller, “mom and pop” owners. Councilmember Buscaino also referred his motion which was advanced by the City Council in December 2021 directing the City’s Administrative Officer (CAO) to report back in 30 days on all emergency ordinances and policies that are in effect for the duration of the local emergency. The purpose of the report is to help inform the Council
about policies that are connected to the City’s declaration of local emergency so that they can determine what actions to consider going forward. The City’s eviction moratorium and rent increase freeze are two ordinances that are tied to the local emergency and; therefore, fall within the scope of the report. While both Councilmember’s Krekorian and Koretz voted to extend the local emergency for 30 more days, they spoke to the importance of the City’s evaluation of the policies linked to the local emergency and the City Council’s review of the CAO report. Councilmember Krekorian stated that it is the Council’s responsibility to analyze the policies that were established in 2020 and make appropriate modifications based on current circumstances and information available. He further indicated that it may be the last time he votes in favor of extending the emergency order unless the report is completed for Council’s consideration. The CAO report was issued on February 17th and is scheduled for discussion at the February 22nd Ad Hoc Committee on COVID-19 Recovery and Neighborhood Investment.
The Apartment Association of Greater Los Angeles has maintained its strong opposition to any extension of the temporary residential eviction moratorium and rent increase freeze and continuously urges the City Council to take immediate action to separate the expiration of these interim emergency measures from the local emergency and allow for these ordinances to expire.
We encourage members to review the full details of the City’s rent increase freeze and eviction moratorium ordinances and seek legal guidance as to questions related to the ordinances’ applicability to a specific tenancy or tenancies.
Los Angeles County Extends Countywide Eviction Moratorium Potentially into 2023
At the January 25th Los Angeles County Board of Supervisors meeting, the Board of Supervisors, by a 4-1 vote with Supervisor Barger in strong opposition, instituted a phased plan extending and reinstating the eviction moratorium and rent increase freeze through 2022 and potentially into 2023.
